The following is a transcription of a record book kept by Jabez Fitch, Jr. who was born 15 February, 1737 in New London County, CT and served as a Justice of the Peace during the dates above. Shortly after the last entry in this book, Jabez Fitch and his family moved to Hyde Park, VT where Mr. Fitch died 29 February, 1812. Jabez Fitch was a founder of Hyde Park, VT.

The original book from which this Justice of the Peace record is transcribed is located in the Wilbur Collection, Bailey/Howe Library, University of Vermont, Burlington, VT.

Typography in this transcription is a reasonable facsimile of the original manuscript. Spelling and grammar are not modernized.

Before Jabez Fitch, Justice of ye Peace for said County: Timothy Clark of said Norwich Plaint: John Barney of New London, in sd County Defendt: Action on Note of hand. Demanding £1·4·0 Lawful money, as pr writ on file Dated Augt 22nd AD 1781: The Plaint appeard to prosecute his Action, and ye Defendt being call'd three times, did not appear, but made Default: whereupon this Court doth consider that ye Plaint Recover of ye Defendt ye Sum of £1·4·0 Lawful money Debt, & his Cost.

Exn to be suspended, by agreement of ye parties, one month.

Josiah Witter & Timothy Brewster, both of sd Norwich, being bro't before this Court, by virtue of a Writ, of ye Governor & Company of ye State of Connecticut, Dated ye 24th of Octr 1781, to answer to ye Complaint of Information of Abijah Park of Preston, a Grand Juror for sd County, Dated ye 14th Day of Augt 1781, for breach of Sabbath in said Norwich, on ye 5th Day of said Augt, as pr Complaint & writ on file: To which ye Defendts Plead not guilty: this Court having Examined ye Evidences produced in ye Cause, under Oath, & fully heard ye parties in their Pleas &c in ye premesses, & duely Considered ye same, is of Opinion that ye Defendts are not Guilty, and doth therefore Consider yt they (ye Defendts) be Dismisst, on paying ye Cost of this prosecution, which is Taxed at £1·5·8 Lawful money.

The above Judgt fully Satisfied

At a Court in Norwich in New London County, Novr 14th 1781. Before Jabez Fitch Justice of ye Peace for sd County, Daniel Fitch of sd Norwich v.s. Silas Brewster of sd Norwich; the Plaint produc'd in Court, a Note under ye hand of ye Defendt Dated ye 25th Day of April 1780, on which ye Defendt Confes'd Judgt for ye Sum of £14·4·0 Lawful money, Debt; Whereupon it is considered by this Court; that ye Plaint Recover of ye Defendt sd Sum. The above Judgt fully Satisfied by agreement of ye Parties.

At a Court holden in Norwich, in New London County, Jany 17th 1782. Before Jabez Fitch Justice of Peace for sd County: Epm Starkweather of sd Norwich Plaint vs. Deborah Park of Preston, in sd County Defendt Action on Book, Demanding £1·0·0 Lawful money, as pr Writ on file Dated Decr 30th 1781: the parties appearing for tryal: The Defendt Pleads that She owes ye Plaint nothing by Book, but that ye Plaint is Justly Indebted to her (ye Defendt) by Book to balance Book accts the Sum of £1·19·6 Lawful money, as pr her (ye Defendts) Book &c on which ye Parties are at Issue; This Court, having duely Examined the Parties Books, together with such Evidence as is produced in ye Cause & fully hear'd ye parties in their Pleas &c in ye premesses, & duly considered ye same, is of Opinion that ye Plaint is Justly Indebted to ye Defendt ye sum of £0·12·0 Lawful money, by Book: and Doth therefore Consider, that ye Defendt Recover of ye Plaint sd sum, & her Cost, which is Taxed at S2/8 like money.

Before Jabez Fitch Justice of Peace for sd County: Joseph Crary of Preston, in sd County Plaint vs. Jeremh Colver of sd Preston Defendt, on a Note under ye hand of the Defendt Dated May 1st 1781 upon which ye Defendt Confest Judgt for ye sum of £10·S7·d9½ Lawful money, Debt, & for ye sum of S11 like money Cost. Whereupon this Court doth Consider yt ye Plaint Recover of ye Defendt ye sd Sums.

David Benjamin of Preston in sd County Defendt: The Plaint in Court producing a Note of hand, Executed by ye Defendt Dated Novr 9th 1781, on which ye Defendt Confest Judgt for ye Sum of £2·S4·d7 Lawful money, Debt, & for ye sum of £0·S6·d6 L.M. Cost; Whereupon this Court doth Consider yt ye Plaint Recover of ye Defendt ye aforesaid sums.

Action on Book, as pr Writ on file Dated Jany 21st 1782 &c Demanding £2·0·0 Lawful money Debt &c: To which ye Defendt Pleads yt sd Writ ought to Abate for yt he (ye Defendt) long before ye Date of sd Writ, & untill ye present time, was & hath been a Lawful Inhabitant of ye Town of South Kingstown, in ye State of Rhod=Island, & not of ye sd Town of Norwich, as set forth in sd Writ: all which he is ready to verify &c; This Court having Examined ye Evidence produced in ye Cause, under Oath, & fully hear'd ye Parties in ye Premesses, is of Opinion yt sd Writ ought to abate, and doth therefore Consider yt ye Defendt Recover of ye Plaint his Cost. At a Court holden in Norwich, in New London County, March 25th 178[2] Present Jabez Fitch, Justice of Peace for sd County; Samuel Leffingwell Jur of sd Norwich Esqr Plaint, v.s. Jonathan More of sd Norwich Deft Action of ye Case &c, as pr writ on file, Dated March 16th 1782, wherein ye Plaint Declairs & says yt he was, & hath been for some time before ye Date of said Writ ye only Lawful keeper of a Ferry in said Norwich, over ye River called Shetucket, near ye Mouth of sd River duely Appointed & Authorised to keep sd Ferry, with ye Sole Right & Liberty of Transporting Passengers &c over sd River at ye Ferry place aforesd, & yt he (ye Plaint) hath been at great Cost &c in procuring a sufficient Boat &c for ye purpose aforesd, & that he (ye Plaint) hath at all times given due Attendance at said Ferry, with help &c sufficient to manage ye same, & yt he hath a Lawful Right to Receive ye Fair Established by Law, to be paid by such persons as pass over sd Ferry, & ye whole profits thereof: all which ye Defendt well knew; yt. ye Defendt without Law or Right, & with Design to Injure ye Plaint, hath for ye space of ten days, last before ye Date of sd Writ kept a Boat on said River, at ye Ferry place aforesd & in ye same Transported 200 passengers &c over said River, & taken ye Fair, or Ferriage there[on] & thereby prevented ye Plaint Receiving ye Fare, or Ferriage of sd 200 passengers &c, For which, wrong Doings of ye Defendt the Plaint Demands S20/L.M. Damages &c. To which the Defendt Pleads yt ye Plaintiffs writ ought to abate, because he saith yt ye sd Justice Fitch, holding sd Court, was at ye Time of ye Appointment of ye Plaint to keep, or tend ye Ferry Refer'd to, in ye Plaintiffs Declaration, & Displacing ye Defendt who was then Tending sd Ferry &c, one of ye Select Men of said Norwich, & Acting therein, & therefore ought not to Judge in ye present Cause. This Court having fully hear'd ye Arguments of ye Parties on ye aforesd Plea, is of Opinion yt sd Plea is Insufficient, & doth therefore Consider yt sd Writ ought not to Abate.

On which ye Defendt Pleads not Guilty. This Court having Examined several Evidences on Oath, in ye Cause, together with a number of Exhibits in writing, & fully hear'd ye pleadings and Alligations of ye Parties thereon, & duely considered ye same, is of Opinion that ye Defendt is Guilty, & therefore doth consider yt ye Plaint Recover of ye Defendt ye Sum of S6/ Lawful money Damages, & his Cost. Cost Taxed S16/d6 L.M.

Asa Waterman Jur of sd Norwich Plaint, John Ellis Jur of sd Norwich Defendt The Plaint produc'd in Court a Note under ye hand of ye Defendt dated April 15th 1782, wherein ye Defendt promised ye Plaint to pay to him ye sum of £15·1·0 L.M. &c. on which ye sd Defendt Confs'd Judgt for sd sum of £15·1·0 L.M. Debt, & for S1/ Cost. Whereupon it is Consider'd by this Court yt ye Plaint Recover of ye Defendt sd Sums.

Before Jabez Fitch Justice of Peace for sd County: John Clark of sd Norwich Plaint vs Hannah Park of Preston, in sd County Defendt Action on Book as pr Writ on file, Dated June 27th 1782 Demanding £0·15·0 L.M. &c The Plaint appear'd to prosecute his Action, & ye Defendt being call'd three times did not appear, but made Default: This Court having Examined ye Plaintiffs Book, is of Opinion yt ye Defendt is Justly Indebted to ye Plaint ye sum of £0·S14·d11½ L.M. & doth therefore Consider yt ye Plaint Recover of ye Defendt sd Sum Debt, & his Cost. At a Court holden in Norwich, in New London County July 9th 1782. Before Jabez Fitch, Justice of Peace for sd County: John Clark of sd Norwich Plaint vs Nathan Tracy of Preston in sd County Defendt Action on Book Demanding £2·0·0 L.M. as pr writ on file, Dated June 28th 1782 &c. The parties appearing for Tryal, The Defendt Pleads yt ye Plaint ough[t] to be Barr'd of having & maintaining his sd Action, & he (ye Defendt) not holden to make further Defense therein; for yt having pray'd oyer of ye Plaintiffs Book, & ye same being produc'd, & Read in Court, it appear[s] yt ye Defendt is Charg'd in Debt by ye Plaint ye Sum of £3·19·8 L.M. which sum is by Law above ye Jurisdiction of this Court &c. This Court is Adjourn'd to ye 7th day of Augt next.

At a Court in Norwich in New London County, Augt 7th 1782, Before Jabez Fitch, Justice of Peace for said County, holden agreable to ye above Adjournment &c; This Court having fully heard ye Alligations of ye parties on ye foregoing Plea in Barr of sd Action, & Duely Considered ye same, is of Opinion that sd Plea is Insufficient, & therefore doth Consider that sd Action is Cogniza[ble] before this Court. The Defendt in Court moves for an Appeal from ye above Judgt which is granted on procuring Bond for prosecuting ye same.

Mr Nathan Fobes of Preston, in sd County, personally appearing, Acknowledged himself to ye Treasurer of ye County of New London in a Recognizance of £10·0·0 Lawful money, to make good all Damages in Case ye aforesd Defendt fail in prosecuting his aforesd Appeal, at ye County Court to be holden at Norwich, in & for sd County on ye 4th Tuesday of Novr next.

At a Court holden in Norwich, in ye County of New London, agreable to ye above Adjournment, Augt 30th, 1782 Before Jabez Fitch Justice of ye Peace for sd County, Hazzard vs Whipple, the Parties appear'd for Tryal, & ye Defendt Pleads that ye Plaintiffs Declaration & matter therein Contain'd are Insufficient in Law &c. The Plaint says that his Declaration &c is Sufficient in Law &c. This Court having fully heard ye Parties in their Alligations &c in the premesses, is of Opinion that ye Plaintiffs Declaration &c is sufficient &c And thereupon doth Consider that ye Plaint Recover of ye Defendt ye sum of £0·18·2 Lawful money Damages, and his Cost.

Before Jabez Fitch Justice of Peace for sd County: Jason Corning of sd Norwich being brought before this Court, by a Writ of ye Governor & Company of ye State of Connecticut, to answer to ye Complaint of Samll Capron of sd Norwich seting forth yt ye sd Corning did on ye 23rd day of Novr AD 1782 Felloneously Take, Steal &c out of ye possession of ye Complainant about 300 weight of Cordage, well worth £80·0·0 Lawful money, & a Quantity of Oak Plank of ye value of S20/ L.M. Praying Process &c as pr Complaint & Writ on file, Dated ye 27th Day of Novr AD 1782, to which ye Defendt Pleads not Guilty. This Court having Examined a number of Evidences on Oath, in ye Premesses, & having fully heard ye Pleadings & Alligations of ye Parties thereon, & duely Considered of ye same, is of Opinion yt ye Defendt is Probably Guilty, and ye Cause not being within ye Jurisdiction of this Court to determine, it is therefore Considered by said Court that ye sd Jason Corning become bound, with one sufficient Surety, in a Recognizance of £80·0·0 L.M. that ye sd Jason appear before ye County Court, to be holden at New London, within & for sd County, on ye 2nd Tuesday of June next, to answer to ye aforesd Complaint, & abide ye final Judgt & Determination of sd Court thereon, & yt ye sd Jason stand Committed till this Judgt be Comply'd with.

Debt, & S/ Cost. it is therefore Considered by this Court yt ye Plaint Recover of ye Defendt ye aforesd Sums. Exn Granted July 23rd 1783.

Before Jabez Fitch, Justice of Peace for sd County: Philip Harvey of sd Norwich, Executor to ye last Will & Testament of Paul Harvey Deceas'd, Plaint Moses Meach of Preston, in sd County Defendt. Personally appeard John Clark of sd Norwich, Principal, & Natll Fitch of sd Norwich, Surety, & Acknowledged themselves bound to ye Treasurer of ye State of Connecticut, Recognizance of £200·0·0 L.M. that ye sd John Clark shall duely Observe, & keep all ye Laws of this State, yt are, or shall be made Respecting ye Excise on any Article whatsoever, & Render a Just, & true acct upon Oath to ye Collector of Excise in ye County aforesd., or his Deputy, whenever Demanded, of all the [A]rticles ye sd John Clark shall have on hand subject to Excise at ye time of Granting his Licence, & of all such Articles as he shall have had, or vended, at or before ye Rendering such acct, & pay ye Excise thereon to such Collector (Substracting one 8th part of such Distilled Spirits, & brown Sugar, for leakage & wastage) all in manner & form agreable to a certain Statute Law of this State. Entituled "An Act for laying an Excise on sundry Articles of Consumption within this State".

At a Court in Norwich, in New London County Novr 2nd 1784. Before Jabez Fitch Justice of Peace for sd County: Nathan Coy of sd Norwich being brought before this Court by a Writ, by Authority of ye State of Connecticut; to answer to ye complaint of Lucy Tracy of sd Norwich, in behalf of herself & this State, seting forth yt ye sd Coy did on ye Evening of the first Day of Novr AD 1784, in sd Norwich, an Assault make upon the Complainant, & did in a violent, & Lasciveous manner pull the Complainant off from her Horse, throw her on ye ground &c, and did wound, & Bruise ye Complainant, to her damage ye sum of £100·0·0 L.M. as pr Writ & Complaint on file, dated ye 2nd Day of Novr 1784 To which ye Defendt Pleads not Guilty. This Court having Examined a number of Evidences on Oath, & having fully fully [sic] hear'd ye Pleas & Alligations of ye Parties theron, & Duely Considerd ye same, is of Opinion yt the Defendt is probably Guilty: And ye Cause not being within ye Jurisdiction of this Court to Determine, it is therefore Considered by sd Court yt ye Defendt become Bound, with one sufficient Surety in a Recognizance of £150·0·0 L.M. that ye sd Coy appear before ye county Court: to be holden at Norwich in & for sd county, on ye fourth Tuesday of Novr Instt. to answer to ye aforesd Complaint & abide ye final Judgt and Determination of sd Court thereon: and yt ye sd Coy stand Committed untill this Judgt be Comply'd with.

Before Jabez Fitch Justice of Peace for sd County: John Clark of sd Norwich Plaint: Cezar Smith (a free Negro man) of sd Norwich Defendt: ye Plaint produc'd a Note under ye hand of ye Defendt Dated April 12th 1785, for ye sum of £6·S12·d0 L.M. Debt, & for ye sum of S1/d6 L.M. Cost: Whereupon sd court doth Consider yt ye Plaint Recover of ye Defendt sd Sums.

Whereas John Clark of Norwich, in ye County of New London, on ye 12th Day of April AD 1785, Before me Jabez Fitch, a Justice of ye Peace for sd County, Recovered Judgt against Cezar Smith (a free Negro man) of sd Norwich, for ye sum of £6·S12·d0 Lawful money Debt & for ye sum of S1/d6 L.M. cost; as appears of Record &c; And whereas ye sd Cezar hath given his Voluntary Consent to be Assign'd in Service to sd Clark, to pay & Satisfie sd sums, & sd Clark likewise agreeing to Accept ye service, & Labour of ye sd Cezar in payment of sd Sums: Whereupon sd Cezar is by Authority of ye State of Connecticut, hereby Assign'd in service to sd Clark, for ye full Term of six months, from ye Date hereof: & sd Cezar is faithfully to strive, & Labour for said clark, ye full term aforesd, for ye payment of ye sums aforesd; and ye sd Clark is likewise Obliged to provide suitable & Convienient Provision Washing & Lodging for sd Cezar during sd term. Before Jabez Fitch, a Justice of Peace for sd County: Zebulon Ames of sd Norwich being bro't before this Court by a Writ, by Authority of ye State of Connecticut: to answer to ye complaint of Oliver Brown of sd Norwich, who Complains as well in behalf of ye State of Connecticut as himself: Alledging that he ye sd Ames did, in Norwich aforesd on ye 17th day of April Instant, did in a furious, Angry & hostile manner &c An Assault make on ye Body of ye Complainant: threatning to Beat: wound &c ye Complainant: terrifying his (ye Complainants) Family &c, to ye Damage of ye Complainant ye sum of £4·0·0 L.M. &c as pr Writ & Complaint on file Dated April 27th 1785. To which ye Defendt Pleads not Guilty: This Court having Examined sundry evidences in ye Premesses & fully hear'd ye Parties thereon, in their Pleas & Alligations, & duely Considered ye same, is of Opinion yt ye Defendt is Guilty, & doth therefore Consider yt ye complainant recover of ye Defendt yesum of S3/ L.M. Damages, & his Cost: And yt ye Defendt also pay to ye Treasurer of ye town of sd Norwich a Fine of nine Shillings, Lawful money, & Stand Committed untill this Judgt is Satisfied.

The Defendt moving for an Appeal from ye aforesd Judgt, & ye same being allowable by Law, is granted, on his procuring sufficient Bail for prosecution &c.

Damages &c. the Defendt in Court pray for Bail, or surety for prosecution &c, as ye Plaint is not posses'd of freehold Estate &c: Whereupon this Court doth Consider, & Order yt ye Plaint procure bail or surety for prosecution &c.

New London County, ss. Norwich June 13th 1785. The Plaint Principal & Danll Brewster of sd Norwich surety, personally appearing in Court. Acknowledged themselves Jointly & severally Bound to ye Defendt in a Recgnizance of S20/ L.M. yt ye Plaint prosecute his Action, & make good all Cost to ye Defendt in Case he make not his Plea good.

And now ye Defendt in Court Pleads &c that he is not Guilty in manner and form as ye Plaint in his Declaration hath Alledgd, & therfore puts himself on Tryal &c. And ye Plaint in like manner puts himself on Tryal.

This Court having Examined a number of Witnesses on Oath, & fully heard ye Parties in their Pleas & Alligations, on ye Premesses, & Duely Considered ye same, is of Opinion that ye Defendt is Guilty, & doth therfore Consider yt ye Plaint Recover of ye Defendt ye sum of £3·0·0 Lawful money Damages, & his Cost. Cost Taxed £2·S5·d9 L.M.

The Defendt in Court mov'd for an Appeal from ye above Judgt and ye same being Allowable by Law, on sufficient Bail is Granted.

The above named Abel Brewster of sd Norwich, (Defendt ) Acknowledged himself Bound to Josiah Witter of sd Norwich (ye aforesd Plaint ) in a recognizance of £15·0·0 Lawful money, Condition'd yt he (ye Defendt ) appear before ye County Court, to be holden at New London, in & for sd County, on ye 2nd Tuesday of June Instant, & prosecute his aforesd Appeal, & make good to ye sd Plaint all Damages & Cost in Case of falure therein.

Demanding £2·0·0 L.M. &c: The Defendt in Court, Pleads & yt he owes ye Plaint Nothing by Book &c but yt ye Plaint is Indebted to ye Defendt &c and puts himself on Tryal &c; & ye Plaint in like manner puts himself on Tryal &c.
